Our guest today is Sandra Richardson. Sandra was the victim of the NY SAFE Act and a false report concerning her mental health.
Sandra is a gun owner, was the subject of a false NY SAFE Act report. Thankfully, the court determined the report against her was “arbitrary, capricious or an abuse of discretion” and her rights were restored.
After that ordeal, she brought together data that clearly shows that the NY SAFE Act has created a very large barrier to mental health care and is ineffective in capturing its target population.
1) The New York Secure Ammunition and Firearms Enforcement Act of 2013 proposes to help keep guns out of the hands of people with mental health issues. But, like so many “well-meaning” laws the NY SAFE Act ensnares people like you who are simply seeking help with normal stress.
2) After regaining your Second Amendment rights, you wanted to understand more about NY SAFE Act reporting and its impact on the public. How did you approach this and what did you find?
3) What do you hope will come from sharing your story and your research efforts?
Raise awareness of the multiple Constitutional violations (2A, 1A, 4A, 6A, 14A) of NY SAFE Act reporting, and awareness of the fact that this kind of egregious reporting system does not protect people, but instead undermines public health by preventing people from seeking care. Hope that others will use this information to help remove both barriers to care and stigma around guns and mental health.
